Mahindra & Mahindra (M&M) has responded to IndiGo's lawsuit alleging trademark infringement over the use of "6E" in its upcoming electric SUV model, the BE 6e. The airline earlier claimed that the name conflicts with its trademarked "6E" branding.

M&M, however, emphasised that the trademarks differ significantly. "Mahindra’s mark is 'BE 6e,' not the standalone '6E.' It differs fundamentally from IndiGo’s '6E,' which represents an airline, eliminating any risk of confusion. The distinct styling further emphasises their uniqueness.," said a company spokesperson.

The automaker revealed the BE 6e alongside the XEV 9e on November 26, 2024, as part of its electric SUV portfolio. Mahindra has trademarked "BE 6e" under class 12 for vehicles, excluding two-wheelers.

"We have taken on board the concerns that InterGlobe Aviation Limited has to infringement of their goodwill, which was not our intention. We are engaged in discussions with them to find an amicable solution," the spokesperson added.

The case, filed in the Delhi High Court, saw Justice Amit Bansal recuse himself, with the next hearing scheduled for December 9.
